Lawyers for President Donald Trump’s administration have withdrawn subpoenas seeking to compel testimony from New York Times reporters who wrote about safety concerns related to the new Air Force One plane.

The move came as a federal judge questioned why Trump officials were seeking the records of three journalists and their families.

The newspaper had published articles alleging that the plane, a gift from Qatar, was unsafe, and the Secret Service urged Trump to change planes on his way home from a NATO summit in Turkey.

Trump officials had said the subpoenas were necessary to prevent government secrets from being leaked, while the Times called them “abusive and inappropriate.”

During a court hearing Thursday, Sean Buckley, lead attorney for the U.S. attorney for the Southern District of New York, admitted that the Justice Department had made some procedural errors in serving the legal subpoenas.

Judge Arun Subramanian told federal lawyers they could try again if they filed new subpoenas.

After the hearing, a Justice Department spokesperson insisted that the investigation into the leak would continue.

“Make no mistake, this investigation is ongoing and we will seek justice against those who threaten national security by leaking classified information, a serious federal crime,” the statement said.

In court papers challenging the government, New York Times lawyers had said federal agents were seeking phone records belonging to the mother of one journalist and the spouse of another.
